Final Notice: Duke Energy Progress Permit Modification

To all interested parties: The Western North Carolina Regional Air Quality Agency (WNCRAQA) announces the issuance of Title V Permit No. 11-628-16B to Duke Energy Progress, LLC (Duke Energy Progress) located at 96 New Rockwood Road in Arden, North Carolina. Duke Energy Progress, Inc. (DEP) has been operating two coal-fired boilers and two natural gas / No. 2 fuel oil-fired, simple-cycle combustion turbines at the Asheville Steam Electric Plant. The coal fired units were retired in January of 2020 and replaced with two natural gas / No. 2 fuel oil-fired simple/combined-cycle combustion turbines that were permitted in 2017 as part of the Western Carolinas Modernization Project. The permit was modified to establish plantwide applicability limits (PALs) for particulate matter in accordance with the Prevention of Significant Deterioration (PSD) program. The primary purpose of the Title V permit is to consolidate and identify existing local and federal air quality requirements applicable to Duke Energy Progress, and to provide practical methods for determining compliance with these requirements. The permit has been prepared in accordance with WNCRAQA Air Quality Code, Chapter 17, Section .0500 – “Title V Procedures” and Title V of the Federal Clean Air Act. This permit is enforceable by WNCRAQA, the U.S. Environmental Protection Agency (EPA), and citizens as defined under the Federal Clean Air Act.

The public notice was issued on December 1, 2019 in the Asheville Citizen Times, and on the agency website. Since this was a significant modification under the Prevention of Significant Deterioration (PSD) program, notification was also sent to the Federal Land Manager contacts including the National Park Service and the US Forest Service. No comments were received from these entities. The public comment period ran through December 31, 2019. The agency received 5 comments on the draft permit. The permit was taken out of concurrent EPA review. In March of 2020, agency staff completed the review of the comments and after consultation with Duke Energy Progress, made some changes to the permit to address the comments. A revised draft permit with an additional testing requirement was submitted to EPA Region 4 by email on March 24th. The 45-day EPA review period ended on May 12, 2020 when EPA Region 4 notified the agency that EPA had no comments on the revised draft permit. Subsequently, the WNCRAQA Board of Directors approved the permit at their meeting on May 18, 2020.
