Register of Deeds Same-Sex Marriage FAQ

Q: My spouse and I were married in another state. Can we get a marriage license in North Carolina? Do we need to register our out-of-state marriage license in North Carolina?

A: If you are a same-sex couple already married in another state, North Carolina will now be able to recognize your marriage. As with heterosexual marriages, you do not need to register an out-of-state marriage license with North Carolina. Your license should be accepted as proof of your marriage in any state that recognizes same-sex marriage.

Q: My partner and I previously applied for a marriage license in Buncombe County, and our application is being held by your office pending a decision on North Carolina’s Amendment One. What do we need to do in order to obtain that license now?

A: All pending applications being held by the Buncombe County Register of Deeds office have expired if it has been over 60 days since the date of application. You will need to re-apply for a marriage license as per the instructions below.

Q: My partner and I want to get a marriage license in Buncombe County. What should we do?

A: To be issued a marriage license, both applicants must appear in person in the Register of Deeds office and present their valid photo identification and social security cards (or other proof of full social security number). If possible, please complete the online marriage application from home via http://www.buncombecounty.org/rodbefore coming to the office so we can have your paperwork ready when you arrive. The cost of a marriage license in North Carolina is $60.00, and we accept cash, check, Visa, and MasterCard.

Q: What do we do once we get a marriage license?

A: A North Carolina marriage license is valid for up to 60 days from the date of issue and can be used for marriage anywhere within the state. By North Carolina state statue, your marriage can be solemnized by an ordained or authorized minister of any religious denomination or by a magistrate. To be valid, both copies of the marriage license must be signed after the ceremony by the officiant and two witnesses age eighteen or older. Both copies of the completed license must be returned to our office within ten days of the ceremony. Once your marriage license has been returned, a marriage certificate can be purchased for $10.00 either from the Register of Deeds office or online at www.buncombecounty.org/vital.

Q: If my partner and I are not from Buncombe County, can we get a marriage license in your office?

A: Yes. Your residence is not considered in your application for a North Carolina marriage license.
