NOTICE OF OPPORTUNITY FOR PUBLIC COMMENT NOTICE OF PUBLIC HEARING
Request for Delegation of authority to implement and enforce the Clean Air Act (CAA) Section 111(d)/129 Federal Plan under 40 CFR 62 Subpart LLL - Federal Plan Requirements for Sewage Sludge Incineration Units Constructed on or Before October 14, 2010
To all interested parties:
The Western North Carolina Regional Air Quality Agency (WNCRAQA) hereby gives notice of a public comment period and hearing regarding its Request for Delegation of authority to implement and enforce the Clean Air Act (CAA) Section 111(d)/129 Federal Plan under 40 CFR 62 Subpart LLL - Federal Plan Requirements for Sewage Sludge Incineration Units Constructed on or Before October 14, 2010. On April 26, 2016 the Environmental Protection Agency (EPA) published in the Federal Register its final Federal Plan Requirements for certain Sewage Sludge Incineration Units with an effective date of May 31, 2016 (81 FR 26040-26088). In accordance with 40 CFR 62.15865, a state or local air pollution control program may meet its CAA obligation by submitting an acceptable written request for delegation of the Federal Plan. Once finalized the request will be submitted to the EPA to transfer authority for implementation of the Federal Plan to WNCRAQA until such time as an updated state plan reflecting the Subpart LLL requirements is submitted to and approved by EPA. If the state of North Carolina submits an updated state plan, the WNCRAQA intends to adopt that plan by reference into the WNCRAQA Code.
A public hearing has been scheduled for 3 p.m. on December 21, 2016 at the Buncombe County Planning and Development meeting room, 30 Valley Street, Asheville, NC. All persons interested in these matters are invited to attend the public hearing. Any person desiring to comment is requested to submit a written statement for inclusion in the record of proceedings at the public hearing. The hearing officer may limit oral presentation lengths if many people want to speak. The hearing record will remain open until December 23, 2016 to receive additional written statements. To be included, the statement must be received by the WNCRAQA by December 23, 2016.
